TERMS AND CONDITIONS

The undersigned hereby waives trial by jury in any action, proceeding or counterclaim brought by either of the parties hereto against the other on or in respect of any matter whatsoever arising out of or in any way connected with this Agreement, the relationship of the parties hereunder, and/or claim of injury or damage.

The undersigned represents and warrants that he/she is the parent or legal guardian of the child who is knowingly entering into this Agreement and engaging the services of the Club and/or its coaches and representatives, with the right to enter into this Agreement.

The undersigned understands that wrestling is inherently a dangerous sport and activity. The undersigned is responsible for ensuring the physical and mental health of their child, including but not limited to ensuring that their child has been cleared to engage in wrestling activities by their physician.

The Club and its coaches and representatives are not medical professionals and do not have medical professionals on site when wrestling activities are being conducted. The undersigned waives any claim arising from the failure of the Club to have medical professionals on site when such activities are being conducted.

To the fullest extent possible, the undersigned waives, for themselves, the child and their respective families any claim or potential claim arising or relating to the wrestling activities conducted by the Club, and indemnifies and holds harmless the Club and its coaches and representatives from any claim or prospective claim, known or unknown, relating directly or indirectly to the wrestling activities or to a breach by this Agreement, together with attorneys’ fees and court costs.

Any personal property brought onto the Club premises is brought at the sole risk and responsibility of the undersigned. The Club, its coaches and representatives shall have no liability for loss or damage to any such personal property.

This Agreement is entered into under the laws of the State of Maryland and the undersigned agree to the exclusive venue of the courts of the State of Maryland in connection with any dispute relating to this Agreement.

The undersigned understands that the Club, its coaches and representatives shall have the right, in their sole and absolute discretion to remove my child from any wrestling activities and/or the Club premises for any reason, including but not limited to the child’s ignoring instructions from the Club’s coaches or representatives or disrupting Club activities. In no event shall the undersigned or my child be entitled to a refund or return of any fees paid to the Club in such event and the undersigned shall be solely responsible for early pick up of my child in such event.

For purpose of this Agreement, wrestling activities include, to the extent provided, transportation to and from wrestling activities.

For purposes of this Agreement, Montgomery Youth Wrestling League, Inc. t/a Capital Wrestling Club.

PHOTO RELEASE

In consideration of value received, I hereby grant Montgomery Youth Wrestling League T/A Capital Wrestling Club (CWC), permission to use my likeness or that of my minor child in a photograph or video, in any and all of its publications, including website entries. I understand and agree that these materials will become the property of CWC. I hereby irrevocably authorize HBP, to alter, copy, exhibit, publish or distribute this photo or video for purposes of publicizing CWC programs and services or for any other lawful purpose. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness or that of my minor child appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph or video. I hereby hold harmless and release and forever discharge CWC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or that of my minor child; or on behalf of my estate or that of my minor child have or may have by reason of this authorization. I am 21 years of age and am competent to contract in my own name. I have read this release before signing below and I fully understand the contents, meaning, and impact of this release.

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19 

The novel corona virus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Capital Wrestling Club and Montgomery Youth Wrestling League (“the Club”) has put in place preventative measures to reduce the spread of COVID-19. Due to the nature of our sport, social distancing is not possible. The Club cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Club could increase your risk and your child(ren)’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the Club and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Club may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Club employees, volunteers, and program participants and their families.
